During March 1-2, 2018 in Metropol Hotel Moscow the XII Forum “Corporate tax planning”, organized by Prosperity Media group and CFO-Russia, took place. Andrey Zuykov, KIAP partner and Head of Tax practice, spoke with the topic: “Unjustified tax benefit: how to defend tax integrity”.
During his speech Andrey told about legal constructions and mechanisms of businesses rights defense in court in cases related to unjustified tax benefit. Using a real legal case as an example Andrey highlighted the problem of making claims to taxpayers on all deductions for VAT and expenses, regardless of the actual budget losses, told about the contradictions in the application of the "tax reconstruction" and touched upon the issues of increasing responsibility of companies for their contractors and the need for caution, despite of contrary statements, declared by Federal Tax Service of Russia. He also shared the information about changes in tax bodies’ approaches during inspections and gave recommendations of how to build successful strategies for preventive protection from tax claims.
