On February 5, 2019 in Sheraton Palace hotel in Moscow was held a seminar "Recovery of problem debts: disputes involving banks and financial organizations", organized by the Russian national Committee of the International Chamber of Commerce – the world business organization (ICC Russia) with a support of KIAP, Attorneys at Law.
Anna Grishchenkova, partner of the dispute resolution and international commercial arbitration practice of KIAP, acted as a moderator of the conference and opened the first session with a presentation on the topic "Financial institutions involved by arbitration".
Anna spoke about the interim results of the joint research of ICC Russia and KIAP "Financial institutions attitude to arbitration proceedings" and focused on the most difficult issues, including: obtaining interim measures in support of arbitration, court assistance in the recovery of evidence, optimization of the cost and timing of arbitration.
She also gave some recommendations to drafting of arbitration clauses. The next speaker was Pavel Bulatov, Advisor of “White & Case” law company, who spoke about the court practice of applying the novels about subsidiary liability by The law 266-FZ and the resolution of the Plenum of the RF armed forces № 53. Dmitry Safonov, head of the legal Department of Sberbank, made a report on approaches to challenging the debtor’s transactions and friendly creditors. The first part of the seminar was completed by KIAP senior associate Ilya Dudkovskiy, who spoke about the responsibility of arbitration managers and the major violations, the Commission of which the courts are often attracted to arbitration managers to administrative responsibility.

The second session was opened by the representatives of the legal Department of UniCredit Bank Ekaterina Anikina and Vadim Shubenin. During the session, Ekaterina and Vadim considered the most difficult issues related to the status of coverage under the letter of credit or guarantee in case of bankruptcy of the applicant (principal).
Nadezhda Tretyakova and Elena Torbeeva, representatives of the legal Department of Sberbank, raised the topic of bankruptcy of a foreign counter-agents and protection of creditor rights in Russia. One of the most intriguing performance was made by KIAP partner Konstantin Astafiev.
He shared with the participants a practical experience and examples of how to use the results of legal investigations in order to research and establish control over the disputed assets.
The last speaker was Dmitry Davydenko, Deputy Chairman Mediators of the CCI of the Russian Federation, with the theme of current situation and development prospects in the settlement of disputes with participation of banks and financial institutions through the mediation process.
Over 60 representatives of litigation and contract divisions of banking and financial organizations, Russian and international law companies, arbitration managers and experts of the documentary business took part in the seminar.
