On Monday, July 13, 2020, Pravo Tech webinar was held on the topic "Early termination of the legal protection of trademarks in a bankruptcy case". Anastasia Skovpen, Associate of KIAP IP practice, acted as speaker of the webinar.
From the moment the court adopted the Supreme Court of the Russian Federation ruling on the application of United Breweries Heineken LLC on the early termination of the trademark of Samara Vodochny Zavod LLC, interested persons apply for early termination of the trademarks in the bankruptcy case of the debtor rights holder.
Having resolved the issue of the jurisdiction of the dispute, the Supreme Court, nevertheless, did not highlight many important points for the applicants. At the webinar, Anastasia Skovpen told how the period of non-use of the trademark of the right holder-debtor is being calculated, whether the stage of bankruptcy should be taken into account, and also what role creditors play when considering a claim for early termination of a trademark.
The webinar was attended by more than 150 participants, including representatives of law firms and in-house lawyers.
