KIAP, Attorneys at law, coorganized the conference “Modern methods of protection of business from counterfeit and other malicious actions of violators of intellectual rights”
On May 25, 2018 the Higher School of Economics (HSE) hosted the annual scientific and practical conference on the protection of business interests "Modern methods of protection of business from counterfeit and other malicious actions of violators of intellectual rights", organized by KIAP, Attorneys at Law,"Feoktistov and partners", Attorneys at Law, and CSI Group.
The conference began with a civil-administrative session, which was held by KIAP lawyers. Daria Chernysh, Head of KIAP IP practice, Trademark and Patent attorney of the Russian Federation, told the participants about the legal niceties in fighting against counterfeit in the civil process, how the gradual preparation for protection is organized, as well as gave practical advice on the selection and justification of the amount of compensation. Alexey Sizov, Partner of KIAP, Attorney at law, Head of Customs and International trade practice, spoke on the protection of intellectual rights within the framework of the import of goods. Alexey explained which powers do customs authorities have and described in detail the legal possibilities of the owner and the consequences for the offender.
The second criminal law session was opened by Gennadiy Esakov, doctor of law, professor and head of the Department of criminal law and criminology of HSE, who spoke about the current aspects of judicial practice in criminal cases related to counterfeit and intellectual piracy. Next session was continued by the representatives of "Feoktistov and partners": Ruslan Dolotov, PhD in Law, attorney at law, partner of "Feoktistov and partners", associate Professor of the Department of criminal law and criminology at HSE, and Sergei Markov, an advisor of "Feoktistov and partners". Ruslan told the participants of the conference about the Criminal code of the Russian Federation as a tool of protection and attack on cases of counterfeit and figured out how to manage the initiation of the criminal case when you have detected the counterfeit on the market. During his speech, Sergey has presented the results of criminological research and estimated the scale and sources of counterfeit of building materials in Moscow, using the analysis of the market.
The third concluding session was devoted to forensic and corporate investigations. This session was held by representatives of CSI Group: CSI group Executive Director Alexander Pisemskiy spoke on the subject of the sale of counterfeit products via the Internet and the example of a comprehensive monitoring of violations and the collection of evidence on the Internet, and gave his practical advice on what to do to fix the evidence. Alexander Khaki, Executive Director of CSI Group, and Andrey Osipov, Head of corporate research of CSI Group, based on a real case-study showed the whole way of building a strategy of counteracting sales of counterfeit products, starting with monitoring of the informational environment and the detection of informal distributors of products in the Russian Federation, and ending with the identification of beneficiaries, the detection of manufacturers and supply chain, as well as the preparation of the position in cooperation with the client's lawyers.
The conference was also attended by Deputy Chairman of the Court for intellectual rights of the Russian Federation Vladimir Korneev. He stressed the relevance of the conference topic and also noted that he considers it extremely important and necessary for business representatives to pay enough attention and resources to monitoring and collection of evidence before going to court, as it can significantly change and accelerate the course of the trial.
The event was attended by business owners and executives, heads and employees of legal departments of leading Russian and international companies, holdings and corporations.
