KIAP, Attorneys at Law, Successfully Secure Enforcement of an Austrian Court Judgment for Legal Costs in the Russian Federation Based on the Principle of Reciprocity

Date: 15.06.2026

Case Overview

KIAP lawyers represented a high-net-worth individual (listed in Forbes) in an Austrian court defamation lawsuit aimed at protecting their business reputation. Following the proceedings, the foreign court ruled entirely in the client's favor, awarding them over RUB 14 million in legal costs. The primary challenge of the project was to secure the recognition and enforcement of this foreign judgment within the Russian Federation, given the highly inconsistent and fragmented judicial practice on the matter.

Despite the complexities of the current international sanctions regime, KIAP’s legal team successfully demonstrated to the court that the principle of reciprocity between the two nations remains intact. The attorneys consistently proved that the absence of a bilateral treaty between Austria and the Russian Federation does not constitute absolute grounds to refuse the recognition of a foreign judicial decree.

Precedential Value and Practical Significance

This case establishes an important precedent, demonstrating that Russian commercial courts are prepared to recognize and enforce foreign judgments even in the absence of an international treaty, provided that baseline standards of due process are met and reciprocity is established. This opens up additional avenues for asset protection and the recovery of legal expenses in cross-border litigation.

The client’s interests throughout these proceedings were represented by KIAP lawyers as follows: Konstantin Astafiev (Partner), Dmitry Kalinichenko (Attorney at Law, Head of Projects of the Criminal Law Practice), and Nikita Zabegaev (Associate).
