New Victory in a Dispute over Infringement of Trademark Rights in the FMCG Sector

Korelskiy, Ischuk, Astafiev & Partners, Attorneys at Law gained a victory in a complex dispute over infringement of trademarks in the interests of major Russian FMCG producer. The subject of the dispute was opponent’s application of the designation confusingly similar to a series of trademarks, registered by our Client in respect of fungible goods.

Experts of the Law Firm succeeded in appealing against the lower court’s judgment, which initially rejected the claim of the plaintiff. The court took into account the arguments of the Law Firm on the need of ascertainment of additional circumstances of the case and investigation of additional evidence. As a result, according to the entered into force decision of the court, there was satisfied the claim of the Client to ban the defendant to use the controversial designation in the future, while ordering him to withdraw from circulation all the products, marked by this trademark.
