Head of division "Government Procurement: legal support and disputes", launched within Antitrust and Competition Practice of KIAP in 2018. Maxim undertakes projects related to government tenders and contracts. Prior to joining KIAP Maxim led litigation teams in commercial companies as well as worked for Russian law firm. Being experienced in civil, antitrust and competition relations Maxim provides a solid support in litigation and administrative procedures. Fluently speaks English.

Projects:

  • Complex consulting and representation of interests of government health facility in litigation on cancelation the negligently performed government contract and defending second tender conditions against antitrust authority. The customer’s interests were successfully implemented.
  • Representation of medical equipment supplier in court action against government customer who refused the supplied equipment referring to improper quality. Taken at cassation stage with negative judicial act the case was returned for reconsideration in accordance with supplier’s position.
  • Consulting of commercial company on protest against government rent tender conditions. The case was settled by agreement. 
  • Consulting of contractor company on admissibility of analog materials according to law and government contract.
  • Defense of group of companies against tender cartel charge by antitrust authority.
  • Defense of general contractor against subcontractor’s claim for work and reimbursement of payments, indirect losses and monetary penalty. The demands were rejected almost in half according to various objections and arguments.
  • Leading the complex defense of international retail company against unfair suppliers:
    • development of legal standards of defense;
    • improvement of corporate procedures;
    • cooperation with hostile before supplier’s creditors to protect mutual interests and reduce involuntary confrontation;
    • winning a series of precedent cases in court.
  • The undertaken efforts prevented immediate losses of approx. RUR 1,5 billion rubles and effectively reduces future risks.
  • Participation in series of court claims on behalf of a private commercial bank (daughter company of international finance group) against major developer. Due to timely and efficient measures the debt of total 1,5 billion rubles was successfully recovered before the debtor’s insolvency occurred.
