Комментарий Степана Султанова о конкурсе по международному коммерческому арбитражу имени Виллема Виса

Russian teams withdrew from the 29th Willem C. Vis Moot that is taking place in Vienna, Austria, these days. This step was taken in support of the Vis Moot, a competition which coaches of the withdrawn teams, being almost every one a Vis Moot alumnus, admire and highlight as one of the brightest moments of their lives. I am one of those coaches and a participant of the 22nd Vis Moot.

In an endless stream of the cancel-culture events of recent weeks, the following announcement of Vis Moot directors was as a break in the clouds:


One of the foundation ideals upon which the Vis Moot is based is that peaceful and respectful dispute resolution is always possible. A second foundation ideal is that respect for the rule of law is fundamental in today’s world. . . . The Vis moot recognizes that many Russian people, both within and without the arbitration community, are just as concerned and distressed by these actions. As an educational exercise that promotes peaceful dispute resolution, the Moot needs to model the behaviors and approaches we advocate. As such we will not be excluding Russian teams from the Vis Moot competition.

I have been proclaiming those words aloud to my colleagues to demonstrate the sign on reasonableness that the Vis Moot community is sharing. As well, I am so concurring with comments of Russian alumni that I have read in the Facebook’s[1] page of Vis Moot: “. . . all Vis Moot participants will always give a hand to each other no matter how bad of a place the world had become.” Reading other comments condemning Russian students made me feel upset and distressed.

The co-coach of the withdrawn team I had been coaching during recent years has sent me an article quoting my words on the importance of participation in international moot courts. I finished reading my words written two years ago with tears in my eyes:

I would also add that international moot courts educate us on how to respect each other and reckon with another opinion, with another law family, with another culture, with another nationality. In such competitions you see how you are different in many things but in the same time united in the main – in pursuing high standards of legal community and in resolution of disputes by civilized and professional means.

This is not easy to share one’s opinion in Russia these days, but we try. This short article is not aimed to do this but I am not going to omit this issue and my personal opinion. I am standing for amicable dispute resolution. That is why I chose legal profession, and Willem C. Vis predetermined my choice in dispute resolution area. I will undertake all possible endeavors to make my country and our world a better place. That is what I have learned from my participation in Vis Moot.

Вот что о конкурсе Виса говорит старший юрист адвокатского бюро КИАП Степан Султанов: «Я рекомендую студентам участвовать в модельных процессах. Такие конкурсы развивают у будущего юриста те необходимые практические навыки, которым не учат или недостаточно учат в классических российских университетах. В рамках конкурса студенты с помощью практикующих юристов учатся правильно писать состязательные документы и убедительно доносить позицию в устных выступлениях. 

Если говорить о международном конкурсе, таком как модель международного коммерческого арбитража им. Виллема С. Виса, то студенты не ограничены одной правовой системой. Участники смотрят на правовые вопросы глобально, применяют к проблеме лучшие мировые практики и научные труды выдающихся авторов. На устных раундах встает задача убедительно донести свою позицию тройке арбитров из разных стран, например из Индии, Бразилии и Швеции, при этом выступая в модельном процессе против студентов лучших университетов мира. После пройденного пути будущие юристы, как минимум, получают те необходимые навыки или зачатки навыков, которые от них ждут будущие работодатели – правильно писать, убедительно говорить, нестандартно мыслить. 

Я бы добавил еще, что международные конкурсы учат уважать друг друга и считаться с иным мнением, с иной правовой семьей, с иной культурой, с иной национальностью. Именно на таких конкурсах ты видишь, насколько мы разные во многом, но в то же время едины в главном – в преследовании высоких стандартов юридического сообщества и в разрешении споров цивилизованным и профессиональным способом».
