KIAP continues to shape case law to benefit retail chains in disputes with bad-faith suppliers

Another court ruling for KIAP client, METRO Cash & Carry.

In its original action for some 55 mln roubles, the claimant alleged that in the period between 2010 and 2012 it supplied goods to the defendant, which were not paid by it in full. KIAP lawyers, however, filed a counterclaim against the claimant for a default on the payment of bonuses (rewards) as well as the service charge under supply contracts. The litigation, drawn out for over a year, resulted in the claimant owing the principal some 3.7 mln roubles following a set-off of the claim and counterclaim. 

KIAP has been representing METRO Cash & Carry in all major disputes against bad-faith suppliers since 2010. The courts have already found for the retailer in several dozen lawsuits totalling 1+ bln roubles.
