Liubov has over 6 years of experience representing her clients in various government authorities and courts of all levels and consulting Russian and international companies on various legal matters. She specialises in commercial, corporate and anti-monopoly disputes and represents her clients in bankruptcy cases, including bankruptcy of credit institutions, and provides legal assistance in obtaining approvals from anti-monopoly authorities.

Prior to joining KIAP Attorneys at Law, Liubov had worked for a Russian consulting firm in Dispute Resolution and Bankruptcy and Anti-Monopoly Law and Bidding.

Bankruptcy

  • Successfully protected the chair of a bank's supervisory board against joint responsibility amounting to over 1 billion Russian rubles at the second round of the legal proceedings;

  • As part of a team, worked on the bankruptcy proceedings of a largest bank in Nizhny Novgorod, including purchase of the claims of independent creditors, representing interests of the bank's shareholders and creditor committee in individual disputes to challenge transactions and include them in the list of creditors (estimated 11 billion Russian rubles). As part of this project, she successfully challenged the argument of the Deposit Insurance Agency on the bank's having concealed records;

  • Represented interests of a leading Malaysian manufacturer of latex gloves in a bankruptcy case against their importer. As a result of her work, some of the claims of the creditors affiliated with the debtor were subordinated and the rest of the claims were rejected and not included in the creditor list; remedies were obtained with respect to assets of the controlling persons for the amount of over 70 million Russian rubles.

Dispute resolution

  • Successfully assisted in collecting over 200 million Russian rubles on behalf of an international company after the interest and default interest had been included in the principal amount; took part in drafting a debt repayment agreement and debt collateral arrangements;

  • Defended a company's director in a corporate dispute resulting in rejected claims to challenge the validity of a transaction and to recover damages in the amount of 20.5 million Russian rubles;

  • As part of a team, participated in challenging the validity and enforcement of three LCIA decisions against the client in the territory of Russia. The decisions were not enforced as a result.

Anti-monopoly law

  • Assisted in obtaining an approval from the Russian Federal Anti-Monopoly Service for a transaction involving one of the largest Russian wine manufacturers' purchase of shares in authorised capitals of various companies as part of the project to consolidate various wine yards in the Russian Federation;

  • Successfully assisted in obtaining an approval from the Russian Federal Anti-Monopoly Service of an M&A transaction involving a large corporation carrying out export and import operations and providing logistics, customs and unique Cargo Village developer services;

  • Assisted in drafting a memorandum on expediency of disclosure of the chain of ownership / beneficiaries of a company for bidding purposes in accordance with Federal Law No.44-FZ dated 05 April 2013 and Federal Law No.223-FZ dated 18 July 2011, including reviewing bidding documents of over 50 companies.
