KIAP, Russian Supreme Commercial Court and RBB Economics Hold a Workshop on “Economic Analysis and Experts in Antimonopoly Cases as Exemplified by European and Russian Practices”

The meeting was held behind the closed doors at the Supreme Commercial Court of the Russian Federation on April 15, 2013, and was participated in by judges and employees of the Russian Supreme Commercial Court.

The workshop speakers were Vitaliy Pruzhanskiy, Doctor of Economics and RBB Economics' Senior Economist; Ilya Ischuk, PhD in Law, KIAP Partner and Attorney at Law; Anna Numerova, Master of Private Law, LL.M., Georgetown University, KIAP Partner; and Andrey Korelskiy, KIAP Managing Partner and Attorney at Law. The workshop was moderated by Andrey Yegorov, chief of staff and administrator of the Supreme Arbitration Court of the Russian Federation.

During the discussions, the participants discussed with the audience diverse approaches to the use of evidence based on the economic content of the provisions of the antimonopoly law in controversies with regulators and the role of economic experts specific to antimonopoly-related disputes. The discussion resulted in the general recognition of an increasing role and importance of economic studies in complex antimonopoly cases and of an emerging role of economic experts as independent and active participants in such proceedings. The meeting also noted the need to amend the existing arbitration procedural laws formalizing the status of such experts and of any documents produced by them as an important part of materials in antimonopoly cases as well as the need to amend the competition laws.
