Transnational Dispute Management journal has published an article analyzing anti-arbitration injunctions and exclusive competence of Russian courts

Foreign companies are increasingly facing matters of Russian courts’ exclusive competence and anti-arbitration injunctions in disputes with Russian sanctioned parties – Articles 248.1 and 248.2 of the Russian Arbitrazh (Commercial) Procedure Code (a.k.a. “Lugovoy Law”).

KIAP’s International Arbitration practice has been actively involved in such disputes, tracking and publishing overview on all the respective cases in Russian courts.

Due to the foreign colleagues’ persistent interest, Stepan Sultanov, the Head of ICA Projects, and ICA practice Associates Anastasiya Ryabova and Natalia Kovalkova have written the article “International Arbitration in Russia: Latest Developments in Response to Sanctions”. The article contains analysis of the latest court practice on Lugovoy Law, statistics on application of Lugovoy Law, and provides an opinion on future development of Russian courts’ practice.
