Stepan Sultanov revealed the results of application of Articles 248.1-248.2 APC RF (Lugovoy Law) at the International Arbitration Conference held by ICC Russia

On 3 December 2024, Moscow hosted the XVI annual Arbitration Conference held by the Russian national committee of the International Chamber of Commerce (ICC Russia).

KIAP sponsored the event which gathered leading experts in the area of international commercial arbitration coming from Russia, Asia, Middle East, and the United Kingdom.

The agenda covered the following three key sessions:

1. 2024 in a nutshell: key challenges and trends for international arbitration.
2. State courts and arbitration: friends or foes.
3. New arbitration hubs: opportunities and challenges.

Head of KIAP’s International Commercial Arbitration practice Stepan Sultanov spoke at the second session, whereby he reflected analysis of Russian court practice on Articles 248.1 and 248.2 of the APC RF (Lugovoy Law) for the last three years. Stepan highlighted that many approaches that used to be viewed as procedural abuses are now perceived as a norm. Stepan spoke both about Article 248.1 APC RF (Russian courts’ exclusive competence on cases involving sanctioned parties) and Article 248.2 APC RF (antisuit injunctions).
