KIAP continues to shape case law to benefit retail chains in disputes with bad-faith suppliers

In its original action for some 55 mln roubles, the claimant alleged that in the period between 2010 and 2012 it supplied goods to the defendant, which were not paid by it in full. KIAP lawyers, however, filed a counterclaim against the claimant for a default on the payment of bonuses (rewards) as well as the service charge under supply contracts. The litigation, drawn out for over a year, resulted in the claimant owing the principal some 3.7 mln roubles following a set-off of the claim and counterclaim. 

KIAP has been representing METRO Cash & Carry in all major disputes against bad-faith suppliers since 2010. The courts have already found for the retailer in several dozen lawsuits totalling 1+ bln roubles.

The dispute was litigated for the client by the head of "Real Estate. Land. Construction" practice Sergey Popov.


Litigation

Litigation is KIAP's core practice. In 2020 Anna Grishchenkova was appointed as Regional Representative of the Russian Federation in the IBA Litigation Committee for the second time, in 2019 she was appointed Deputy Chairman of the ICC Russia Commission on Arbitration. Anna is also a Regional Ambassador at HK45 - Hong Kong International Arbitration Centre’s committee (HKIAC). She is included into panel of arbitrators in Hong Kong (HKIAC) and into list of arbitrators in Austria (VIAC), Kuala Lumpur (AIAC), Korea (KCAB INTERNATIONAL) and Russia (the Board Member of the Russian Arbitration Center). Among the practice's clients are major Russian and international companies from various sectors of the economy.
