On September 24, after a number of court hearings in the bankruptcy case at the Moscow Region Arbitration Court, KIAP lawyers managed to prove the legitimacy of the interests of the owners of a large distributor of climate equipment in a dispute over invalidating purchase and sale contract for warehouse property worth 115 million rubles.
The plaintiff referred to the conclusion of the contract just before the bankruptcy of the owner at a non-market price, as well as to the privileged position of the Firm’s Client in relation to other buyers. The lawyers managed to prove that the transaction was made at a price close to the market price, the deviation from the market is not significant for the purposes of applying the Bankruptcy Law, executed by the parties in full, and the buyer is not the concerned party or affiliated with the seller.
